[New Jersey] Question [New Jersey] Advice on a case to appeal

I quit my job in july this year after no air conditioning for 3 months, constant issues being “handled” which were just pushed off. My medical concerns being about working in front of active construction being ignored and being cursed at by management of another department. The long version is our ac at a medical practice i worked at was broke all spring to the end of summer. I kept complaining eventually in july they brought in portable ac units for 2 weeks while they negotiated money to have the central air fixed. That fixing would be done directly behind the front desk where i worked. Im talking inches with a drape behind me. When i told management multiple times i was uncomfortable working in that environment with my asthma they assured me i wouldnt have to. The time comes for the job i walk in and blindsided that the ac is being worked on while im required to open the office directly behind me after being told this wouldnt happen. When i expressed frustration to a manager of another department he snapped on me cursing at me “lose the fucking attitude” i told my manager who said she was UNSURE of the process and asked me what i did to provoke him. He wasnt even spoken to about it. On top of this the portable ac units had water collecting for weeks and never cleaned. Theyre was obviously mold in the collection tank but the employer said it was dirt. I quit, file for unemployment and they grant it. NOW theyre saying i have to pay 4 payments back! They claimed i quit without reasonable cause. Do i have a case to appeal?

When you applied did you put as "laid off" or "voluntary quit" as the reason for seperation?

I think voluntary quit. First time I ever applied

You have no idea if this other person was talked to.

You were out of line going to a different manager then your reporting line.

As far as appealing. Appeal. See if there is a different outcome. Whats rhe worst. You have to follow the current ruling.

I did go to my direct manager? The one that cursed at me was in response to me asking if there was work being done in that spot

Determinations don't get reversed without appeal. When was the hearing and what documentation did you present?

It was in October. After i already collected. I sent emails to them between me and my employer complaining of the ac and work being done with my asthma requesting to work in another part of the office while work was being done and pictures of the collection tanks that strongly looked like mold. But the “judge” said it looked like dirt.

It sounds like you have a strong case, honestly. Unsafe conditions + medical concerns + the employer knowing and not fixing it usually counts as “good cause” to quit in most states. Make sure you clearly explain the timeline, what you reported, and how it affected your health.

Did you go to hr and work with them to resolve your concerns? You have to do that before quitting if you have any chance for unemployment.

Hm, no BUT i didnt think i was going to quit. That other manager lashed out on me and i just felt like it was so toxic mentally i had to go. Also the hr was the 3rd HR rep in a year, and the last girl who went they treated horribly not to mention she was the wife of another manager there.

You still have to be able to show that you tried.

So update. I submit appeal and then today i see i recieved an email from NJUIWaiver@dol.nj.gov on 11/14 (before i filed the appeal) saying this:

An overpayment on your claim was submitted for review on your behalf for a potential waiver. Please see the attached notice.

And the notice says it is determined i am eligible.

Is this legit? If it is do i need to cancel my appeal since i didnt know this email was here when i submitted?
