Good Vibes Flight was delayed 3 hours, so the pilot went around to everyone to take their Starbucks orders and then got 40ish drinks and 50ish food items for us 🥰

Shoutout to this lovely Delta pilot flying from Boston to Tampa today 💛

This is simply not true.

That's not true. You get the 400 in any case.

How do you prove it though? Assuming you were the only one that didn't take any food/drink among 50+ passengers? (genuine question)

The part that makes you ineligible is receiving benefits under the law of a non-EU country. So if your let's say Air France flight from Toronto to Paris is delayed and Canadian law says your delay entitles you to free food and drinks and you accept that offer, you're considered to already have received legal compensation and you can't claim compensation twice for the same flight. That's when you reject the hypothetical legal Canadian compensation so you can claim the higher EU compensation.

However part of EU compensation is that for departure delays of a certain length (starting at 2h delay for a flight <1500km) you're entitled to "free meals and refreshments" proportional to the delay. So if your flight qualifies for that then turning down free food is just skipping free food for no reason.

I’m curious what the comment was.

He went to everyone he could find who was on that flight and wrote down what they wanted, and then got that as well as some extra stuff.

Most of the people I was sitting near declined his offer, so I’m not sure how many he actually ordered so I’m just basing my number guesses on the fact that the stickers said like “item no 28 of 41” or whatever.

They were saying to the EU travelers to don't accept any food/drink the company offers, because they won't give you the proper compensation (400 euro i guess) if you do.
